Focused geographic guidance

State-specific context without losing the federal framework.

The core 1031 exchange rules and deadlines are federal. The property itself is local: title customs, closing professionals, leases, minerals, timber, water, farm operations, and mixed-use facts vary by transaction and region.

North Oak Exchange coordinates the qualified-intermediary mechanics while each exchanger’s attorney, CPA, title professional, broker, and lender address their respective legal, tax, title, investment, and financing responsibilities.

Each guide includes local property considerations, planning scenarios, federal deadlines, FAQs, and direct access to the exchange questionnaire.

Across state lines

The sale and replacement property do not have to share a state.

The federal like-kind standard is broad for qualifying real property. An exchanger may move from farmland to rentals, timberland to commercial property, or one U.S. state to another when the intended use and exchange structure otherwise qualify.

Before closing

The QI must be in place before proceeds move.

North Oak Exchange prepares the exchange agreement, assignment documents, notices, and funding instructions with the transaction team before the relinquished property transfers.

Frequently asked questions

State and cross-border exchange FAQs

General education is not a substitute for advice about your transaction.

Can I exchange property from one state for property in another?

Generally, qualifying U.S. real property may be like-kind to other qualifying U.S. real property even when the properties are in different states. The taxpayer, ownership, intended use, identification, and closing structure still matter.

Do states change the federal 45-day and 180-day deadlines?

The principal identification and exchange periods arise under federal law. State tax reporting, withholding, title, and transaction requirements can still differ and should be reviewed with the exchanger’s tax and legal advisers.

Does North Oak Exchange only serve these eight states?

No. North Oak Exchange serves property owners and professional teams nationwide. These pages provide focused guidance for eight states where land, agricultural, recreational, rental, and commercial exchanges are especially relevant to our regional work.

When should a qualified intermediary be engaged?

Before the relinquished property transfers and before the exchanger receives or controls the sale proceeds. Contacting the QI while the property is listed or under contract gives the closing team more time to coordinate.
